Between Wristband Giant USA — hereinaftercalled “Wristband Giant USA”
1. Agreement
These terms and the provisions herein shallconstitute the entire agreement (collectively, the “Agreement”) between theparties hereto. It is understood and agreed that there are no agreements,promises, representations, or understandings other than those appearing herein.This document constitutes the complete contract between the parties.
2. Service Updates
Because we normally process orders veryquickly, orders placed cannot be cancelled without our written consent, nor candeferred deliveries of goods in process be extended beyond the originaldelivery date specified, except with our written approval and upon terms thatindemnify us against all loss. Therefore, custom and late orders cannot becancelled, refunded, or discounted.
3. Warranties
Wristband Giant USA warrants that the goodssold are of merchantable quality at the time of delivery and are manufacturedin accordance with the buyer’s specifications, drawings, or other descriptions.Wristband Giant USA conveys good and marketable title to them, subject to itssecurity interest. Except as expressly provided in this Agreement, WristbandGiant USA excludes all express or implied warranties, conditions, andobligations, whether statutory, oral, or otherwise, concerning the quality ofthe goods or their fitness for any use or purpose.
Wristband Giant USA specifically does notwarrant the accuracy or sufficiency of any advice or recommendations given inconnection with the sale of goods. Wristband Giant USA assumes no risk nor willit be liable for any damages resulting from the application or use of themerchandise. Submission of a purchase order (P/O) constitutes acceptance of oursamples, product quality, and these Terms and Conditions of Sale.
4. Limitation of Liability Regarding YourShipped Order
Wristband Giant USA shall not, under anycircumstances, be liable for prospective profits or for any special, indirect,consequential, punitive, or exemplary damages, including but not limited to:injuries to persons, damage to property or equipment, loss of profit orrevenue, cost of capital, replacement goods, or claims for serviceinterruption.
At its sole option, Wristband Giant USA willeither:
● Replace any defectivegoods,
● Refund the purchaseprice upon return of defective goods, or
● Providea credit equal to the value of any authorized return.
This shall be the buyer’s exclusive remedy. Nogoods shall be returned without Wristband Giant USA having a reasonableopportunity to investigate the claim. Comparable products may be substituted atour discretion to fulfill orders quickly.
5. Return of Goods
No goods may be returned to Wristband Giant USAwithout prior written authorization. Acceptance of returns for stock items isat the full discretion of Wristband Giant USA. Returned stock items are subjectto a minimum 40% restocking fee. Transportation charges for returned goods arethe buyer's responsibility unless otherwise agreed.
Approved returns will receive a credit only—nocash refunds.
The customer assumes full responsibilityfor the accuracy and use of provided artwork and indemnifies Wristband GiantUSA against any copyright or trademark claims. Approval of artwork implieslegal authorization to use submitted designs and full acceptance of theseterms.
No returns, cancellations, refunds, ordiscounts will be accepted for custom orders. All sales are final. Submissionof signed artwork, email confirmation, or P/O indicates acceptance of productquality and print.
6. Delivery
Delivery dates are approximate and notguaranteed. Wristband Giant USA shall not be held liable for delays caused byshipping carriers or external factors beyond our control.
7. Inspection
The buyer agrees to inspect all material within10 days of receipt. Failure to do so constitutes full acceptance of the productand fulfillment of the agreement.
8. Custom Orders
Wristband Giant USA reserves the right toinspect any returned goods on the buyer’s premises or retrieve them at thebuyer’s expense. We are not responsible for damages or claims arising from theuse of our products.
Claims for shortage must be made within 10 daysand must include shipping weight and item count method. Exact color matches orprecise quality cannot be guaranteed. Slight variations may occur and will notbe considered grounds for cancellation or discount.
Pantone® color approximations are made to thebest of our ability, but some variances may occur due to material and printinglimitations.
All custom orders are non-refundable andfinal. Slight deviations in print quality, especially with black or full-colordesigns on white backgrounds, are possible.
By placing a custom order, the customer agreesto these terms.
9. Title, Risk of Loss, and Security Interest
Risk of damage or loss passes to the buyer upontender for delivery at the FOB point. Title remains with Wristband Giant USAuntil full payment is received.
Wristband Giant USA retains the right toreclaim unpaid goods and enter the buyer’s premises to do so if necessary.
10. Taxes
All applicable taxes or charges levied bygovernment authorities, directly or indirectly, will be paid by the buyer oradded to the invoice.
11. Paragraph Headings
Headings are included for convenience only anddo not affect the meaning or interpretation of these terms.
12. Artificial Intelligence (AI) Consent
Wristband Giant USA may use AI tools to improvecustomer experience. By placing an order or submitting any form ofcommunication, you consent to being contacted by our AI assistant, Eve, viaemail, phone, or SMS.
This may include:
● Promotions, specialoffers, and product updates
● 24/7 support forproduct inquiries and quotes
● Assistancevia automated systems and third-party platforms
You may opt out at any time by contacting us orunsubscribing.
Wristband Giant USA complies with allrelevant data privacy and communication laws and is committed to using AIresponsibly and transparently.
